. stephen elop takes over as c.e.o. later this month. he was the head of microsoft's biggest division by sales, its business software unit. he takes over a company that sells more mobile phones than anyone else. in the second quarter, nokia's name was on more than one out of every three mobile phones. but, critics say, it is behind in the smartphone market. it is expected to answer critics next week with its n8 smartphone. it will be unveiled in london. one question is whether or not any u.s. carriers have signed on. shares were up 2% on three times its usual volume. the big drop in april came when nokia cut its profit outlook. the trio nokia is competing with for phone software is google, research in motion and apple. tech consultant firm gartner thinks google's android phone software will be the second biggest by the end of this year. nokia remains the biggest. this threesome made fractional moves today. and, the f.d.a. o.k. for a return to the market of a potassium drug provided for some big moves for its maker, k.v. pharmaceutical, and its competitor watson. k.v. rocketed up 74%.

in the triple murder trial of stephen hayes, one of the two men accused of invading a home of a connecticut doctor. you may remember the chilling 911 tapes we've been listening to the last several weeks. the doctor's wife was killed. two daughters killed. the home set on fire, only he made it out alive. legal contributor sunny hostin from "in session" our sister network true-tv joining us from new york. prosecution is wrapping up the case. did they make their case? >> you know, i think that they certainly made their case. evidence is really overwhelming against this particular defendant, stephen hayes. today we heard the final testimony from the fire investigator, and he just got off the witness stand, actually. the lawyers are back in the courtroom, and we believe that the defense may present some evidence. brief evidence. in defense of mr. hayes, but i will say the burden is always on the prosecution, drew, to prove their case beyond a reasonable doubt. everyone watching the trial i have been in new haven, connecticut, watching the trial will tell you the evidence against this defendant i

theoretically won. >> it's so funny, you a great story in the piece about stephen colbert telling his wife their friend, jon stewart had been chosen to host "the daily show." >> she said, wait a minute, he was the quiet guy in the corner with the beard, not the funny one. what's he doing getting the show? stewart is a very smart guy. there's no magic formula as he says. he's worked hard at his humor, getting booed off stage in all the standard sort of start-up things. he lucked into a niche in some ways, "the daily show" existed before he took over as house. it wasn't nearly as political, as topical. he knew he wanted to give it some weight. but some things that have happened in the real world, many of them not funny, have given him openings. and the polarization of media, cable channels, fox obviously the biggest culprit, has given stewart a middle to both poke fun at and sort of represent in some ways. it's going to be interesting, with this rally he talked about last night, he seeing it as a piece of theater, as another goof on glenn beck and everybody else. whether he can do that and n
